{"id":216,"date":"2011-07-26T15:40:55","date_gmt":"2011-07-26T15:40:55","guid":{"rendered":"http:\/\/67.20.69.208\/wordpress1\/?p=216"},"modified":"2011-07-26T15:40:55","modified_gmt":"2011-07-26T15:40:55","slug":"nwc-comments-cwa-draft-guidance-7-26-2011","status":"publish","type":"post","link":"https:\/\/waterways.org\/wordpress2\/nwc-comments-cwa-draft-guidance-7-26-2011\/","title":{"rendered":"NWC Comments: Clean Water Act Draft Guidance"},"content":{"rendered":"<p><em>EXCERPT:<\/em><\/p>\n<p>Dear Ms. Downing and Mr. Olson:<\/p>\n<p style=\"padding-left: 30px;\">On May 2, 2011, the U.S. Environmental Protection Agency (\u201cEPA\u201d)\u00a0and the U.S. Army Corps of Engineers (\u201cCorps\u201d) (together, \u201cthe agencies\u201d)\u00a0published a notice of availability of a document entitled \u201cDraft Guidance on\u00a0Identifying Waters Protected by the Clean Water Act\u201d (\u201cDraft Guidance\u201d). 76\u00a0Fed. Reg. 24479 (May 2, 2011). This letter provides the comments of the\u00a0National Waterways Conference (\u201cNWC\u201d) on the Draft Guidance.\u00a0NWC has a number of concerns about the Draft Guidance. NWC urges\u00a0the agencies not to use a process that results in the issuance of guidance. This\u00a0procedure offers no advantage to the agencies\u2019 efforts to gather information or\u00a0develop policy, but it imposes a severe disadvantage for permittees who are\u00a0concerned about the imposition of unlawful permit conditions. A rule making\u00a0is more appropriate where, as here, the proposal is a significant departure from\u00a0current law and would substantially impact the regulated community. The\u00a0Draft Guidance also exceeds the authority provided by Section 404 of the\u00a0CWA, as interpreted by the Supreme Court. Contrary to Rapanos, it would\u00a0apply jurisdiction where the nexus to navigable waters is not \u201csignificant.\u201d\u00a0Contrary to SWANCC, it would cover isolated interstate waters.
