The U.S. Army Corps of Engineers has issued a Notice of Proposed Rulemaking entitled “Use of U.S. Army Corps of Engineers Reservoir Projects for Domestic, Municipal & Industrial Water Supply.”  The long-awaited proposal seeks to update and clarify the policies governing the use of Corps’ reservoir projects pursuant to Section 6 of the Flood Control Act of 1944 and the Water Supply Act of 1958.  Among other things, the proposed rule would define key terms under both statutes, respond to issues that have arisen in exercising these authorities, and enhance the Corps’ ability to cooperate with state and local interests in the development of water supplies through the operation of Federal reservoirs.  NWC’s Legislative Policy Committee is reviewing the proposed rule. Comments must be submitted to the Corps by February 14, 2017.
